What is Covered: This Contract covers parts and labor costs resulting from a Breakdown of the Product caused by defects in workmanship and/or materials, including those resulting from normal wear and tear and loss of pearls, diamonds and other gemstones due to a defect in the setting. We will repair or replace the product, at our discretion, when required, due to a breakdown. We will NOT replace a piece of jewelry which is lost altogether due to any circumstance. There is no deductible required to obtain service for Your Product.
Term of Coverage: The term of this Contract begins on the date you purchased your jewelry and continues for a period of one (1) or two (2) years. After the period of coverage your pearls are no longer covered under any circumstances. All repairs and replacements of your covered product must be done by Seller and no other third parties, unless the Seller explicitly consents. Any alterations made to your jewelry piece by any third party will automatically void your warranty and release the Seller from any further obligation in honoring the warranty.
Limit of Liability: For any single claim, the limit of liability under this Contract is the least of the cost of (1) replacement with a product with similar features, (2) repair of the product directly by the seller (3) the purchase price You paid for the jewelry including appropriate sales tax. The total liability under this Contract is the purchase price You paid for the Product. In the event that the total of all authorized repairs exceeds the purchase price paid for the pearls or we replace the jewelry with another item of equal or greater value, We shall have satisfied all obligations owed under this Contract.
WHAT IS NOT COVERED: (1) INCIDENTAL, CONSEQUENTIAL OR SECONDARY DAMAGES; (3) DAMAGE FROM ACCIDENT, ABUSE, MISUSE, INTRODUCTION OF FOREIGN OBJECTS INTO THE PRODUCT, INCLUDING BUT NOT LIMITED TO TAMPERING WITH PRONGS, BEZELS OR OTHER ELEMENTS DESIGNED TO SECURE DIAMONDS OR GEMSTONES, UNAUTHORIZED MODIFICATIONS OR ALTERATIONS TO THE COVERED PRODUCT, OR FAILURE TO FOLLOW THE MANUFACTURER'S INSTRUCTIONS; (4) THIRD-PARTY ACTIONS (FIRE, COLLISION, VANDALISM, THEFT, ETC.); (8) BREAKDOWNS WHICH ARE NOT REPORTED WITHIN THIRTY (30) DAYS AFTER THE EXPIRATION OF THIS CONTRACT; (10) FLAWS IN GEMSTONES; (11) LOSS OF DIAMONDS, GEMSTONES, OR ANY OTHER PARTS OF THE COVERED PRODUCT UNLESS SUCH LOSS WAS CAUSED BY A DEFECT IN WORKMANSHIP AND/OR MATERIALS, WITHOUT ANY UNDUE STRESS OR DAMAGE, INCLUDING BUT NOT LIMITED TO TAMPERING WITH PRONGS, BEZELS OR OTHER ELEMENTS DESIGNED TO SECURE GEMSTONES; (12) ANY LOSS OTHER THAN A COVERED BREAKDOWN OF THE PRODUCT; (14) SCRATCHES, PEELING AND DENTS, WHICH ARE PART OF NORMAL WEAR AND TEAR; (15) UNAUTHORIZED REPAIRS AND/OR PARTS; (17) ACCESSORIES USED IN CONJUNCTION WITH A COVERED PRODUCT; (19) DELAY IN RENDERING SERVICE UNDER THIS CONTRACT OR LOSS OF USE DURING THE PERIOD THAT THE COVERED PRODUCT IS AT AN AUTHORIZED REPAIR FACILITY OR OTHERWISE AWAITING PARTS; (21) PERIODIC CHECKUPS AND/OR PREVENTATIVE MAINTENANCE AS DIRECTED BY THE MANUFACTURER; (22) PRODUCTS WITH REMOVED OR ALTERED SERIAL NUMBERS. (24) NONFUNCTIONAL OR AESTHETIC PARTS INCLUDING BUT NOT LIMITED TO PLASTIC PARTS;
Definitions: (1) We/Us/Our: The company obligated under this Contract, as indicated in the "Obligor" section of this Contract; (2) Breakdown: The mechanical failure of the Product caused by defects in workmanship and/or materials; (3) Product: The consumer item(s) which You purchased concurrently with and is covered by this Contract; (4) You/Your/Warranty Holder: The individual who purchased the Product and this Contract, or the authorized assignee.
Transfer: This Contract may NOT be transferred.
Renewal: This Contract is renewable, at Pure Pearl’s discretion. Service Contracts can be renewed before the end of each term by calling us at 1-800-762-0977.
Cancellation: In the event You cancel this Contract within thirty (30) days of receipt of this Contract, You shall receive a full refund of any payments made by You under this Contract.
Insurance: This is not a contract of insurance and this protection plan only serves to repair existing items. This plan will NOT allow for a complete replacement of an item at ANY time.
Arbitration: Any controversy or claim arising out of or relating to this Contract, or breach thereof, will be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. A judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The parties specifically agree to the binding nature of the arbitration.
