PARTICIPATION IN THE PUREREWARDS PROGRAM
If you are a member of the PurePearls.com PureRewards Program, you only need to read and agree to this Agreement. If you are not a member of PurePearls.com PureRewards Program, you must sign up using the Customer Account form to join and then read and agree to this Agreement. The purpose of this program is to reward our members with valuable PurePearls.com merchandise. Members of our PurePearls.com PureRewards Program will be awarded with PearlCash when purchasing any items from PurePearls.com. Members will earn 5% of the total sale amount of the products purchased up to $1000. Sales over $1000 earn 2% into PearlCash. Members can continue to earn PearlCash with each subsequent purchase and redeem the PearlCash at any time by logging into the account and selecting "Redeem PearlCash". A gift certificate will be generated for use at PurePearls.com. The gift certificates cannot be used with any other offer. The gift certificate program is subject to change at any time. PearlCash can also be earned by using our Refer-a-Friend program. When a member refers others to our website through our Refer-a-Friend page, the member's friend will receive a $10 coupon and the PureRewards referrer will earn 2% of the total sale which will be reflected in the member's PureRewards account.
This agreement regulates participation in the PurePearls.com PureRewards Program only.
Once you are a member of the PurePearls.com PureRewards Program, you will be able to participate in the Program subject to the terms and conditions of this Agreement. The PurePearls.com PureRewards Program components including products, gift certificates, rewards amounts, memberships, and policies are applied at the sole discretion of PurePearls.com. The above list is not exhaustive & can be modified by PurePearls.com when required without notice or any form of communication to PureRewards Program members.
AGREEMENT
This Master Agreement ("Agreement") is made between AG Raab Investments, LTD ("PurePearls.com") and you ("Member").
TERMS AND CONDITIONS
In consideration of the promises set forth below, we agree as follows:
1. Length of Program
The PurePearls.com PureRewards Program began July, 20th 2006 but was modified for on September 13, 2006 for more customer earning potential. The program will continue until PurePearls.com decides to terminate the program. In the event that dissolution of the program occurs, all rewards will be valued at zero. PurePearls.com has the sole ability to end the program at anytime. PurePearls.com is not liable for communicating to members the termination of the PureRewards Program.
2. Becoming a Member
Each member will be provided with one access email & password to enter into their account for the PurePearls.com PureRewards Section through the Internet. Entry can be made by bookmarking the PureRewards Program page or visiting www.purepearls.com. Follow the link to the PurePearls.com PureRewards Program and complete the required information for registration. No responsibility is assumed for electronic breakdown, glitches in internet or satellite connections, internet failure or unauthorized human involvement.
3. Rewards
Members will receive gift certificates based on net sales of purchases that are generated through the provided link to PurePearls.com. For every $100 purchase, members receive $5 towards PurePearls.com merchandise. If a referred friend makes a purchase for $1000, the member who referred the friend will earn $20 PearlCash in their PureRewards account. There is no limit on total amount that can be earned. PurePearls.com will generate gift certificates only if the amount in his/her rewards account is over $7.50. Each month, the amount will continue forward until earnings exceed $7.50. The dollar amount is generated in a gift certificate that can be used towards the purchase of any PurePearls.com merchandise. Gift certificates can be redeemed at any time through the PureRewards account.
The PurePearls.com PureRewards Program began on July 20, 2006, and no purchases prior to that date will be calculated. Calculations occur at time of sign-up into the PureRewards system.
4. No Returns or Exchanges
When a Rewards Gift Certificate is used, no returns or exchanges will be accepted under any circumstance once the package has been shipped out to a member, unless the order is in error on behalf of PurePearls.com. Once the merchandise is shipped out, no stipulations will be made under any circumstance for exchange or return and the gift certificate will not be reimbursed.
5. General Conditions
Members will be entered into the PurePearls.com Rewards Program once registered. To unsubscribe, send an email to pearls@PurePearls.com with removal request from the program. This Program is void where prohibited by law. PurePearls.com reserves the right to disqualify any individual it finds tampering with the registration process, the Rewards section or the website and to be in violation of the PurePearls.com Policies and Conditions of the website. PurePearls.com will prosecute any fraudulent activities to the full extent of the law.
6. Limitations of Liability
PurePearls.com will not be held responsible for incorrect or omitted information provided to us while filling in the registration information. Correct email address must be provided to receive updated information and rewards.
7. Disagreements
As a state of a customer entering the PurePearls.com PureRewards Program, the customer agrees that any and all disagreements which cannot be settled between both parties, and causes of action arising out of or connected with this Rewards Program, shall be settle individually, without routing to any form of class action, exclusively, before a court having competent jurisdiction, which Court shall apply the laws of the State of Texas without regard for doctrines of Conflict of Law. In the case of such disagreement, the member will not be allowed to obtain the rewards and waives all rights to claim incidental, punitive or consequential damages, or any other damages, including and not limited to attorneys' fees. The member also waives all rights to have damages increased.
